Advice, Please.....

Hey Blogger Friends -

You may or may not have noticed, but I've got another Blog-A-Brewin'. It is my Soundtrack for a Waiting Mother & I've got it listed in my sidebar right now. No cyber-work has been done on it but loads of thought & ink has been spent.

My hesitation in getting going with it is due to concerns I have about quoting song lyrics. I want/need to do so - but am not sure how Kosher that is. Certainly everything I intend to reference is copyrighted.

Does anyone know if I can quote song lyrics as long as I footnote the copyright information? (e.g. Run/Snow Patrol/released 3/30/04).

I would greatly appreciate any thoughts or guidance that you could offer.

Thanks.

Great question! I'm not sure if I can help you, but I will try to look some things up online and report back.

I think it's okay so long as you're not generating any profit from what you're doing. If you are making money off your other blog, then you owe royalties to all parties involved in creating the music you're using.

..and now from the expert everyone hates, your friend the trademark and copyright lawyer...I've been booed on many other blogs/yahoo groups, so you won't hurt my feelings if you want to stick your tongue out at me.... send me an email in PRIVATE so I don't blast out-of state legal advice to you!!

NOTE TO ALL: profit is irrelevant--it is the actual act of copying and act of distributing that are not allowed without the copyright owner's permission).

What about the possibility of linking to another site with the lyrics you want to share?

I couldn't find anything absolute for you, sweet girl.

Yeah, I do that all the time. Never been caught (knock wood). And if you are, I assume all they'll do is ask you to take the copyrighted material down.

However, Melody is correct in her statement (One of the atty's I work for is a patent/copyright atty).

Now I know why I decided to ditch law school after the first semester.

I would have thought it okay if full credit given and no profit made.

There's obviously a reason I'm a medical person ;0)
